These Terms of Service govern your use of thewaitlist.com and the thewaitlist queue management service, operated by Halp Holding LLC (“thewaitlist,” “we,” “us”). By creating an account or using the service, you agree to these terms. These terms apply to business owners — the businesses and individuals who create and manage queues using thewaitlist.
SMS / Text Messaging Terms

These SMS terms govern the text messages you receive when you join a waitlist at a business that uses thewaitlist, a queue-management service operated by Halp Holding LLC(“thewaitlist,” “we,” “us,” or “our”).
- Program description— When you check in to a participating business through thewaitlist, we send automated text messages about your place in line: your current position, a heads-up when you are next, and a notification when it is your turn. Messages relate only to the specific business you checked into.
- How you opt in— Providing a mobile number and receiving texts is optional. You can join the line with just your name and watch your position on the page — no number, no texts. If you do want text updates, enter your mobile number and check the SMS consent box on the join form; checking that box is your consent to receive recurring automated SMS notifications from thewaitlist about your place in that business’s line. Consent is not required to join the line or use the service.
- Message frequency— Message frequency varies and depends on your activity in a queue. You will typically receive a few messages during a single visit: a check-in confirmation, optional position updates, and a “your turn” alert.
- Cost— Message and data rates may apply, depending on your plan and carrier. thewaitlist does not charge you for these messages.
- How to opt out— You can cancel SMS notifications at any time by replying STOP to any message. We will send a one-time confirmation, after which you will receive no further messages. To rejoin, reply START or simply join a queue again at thewaitlist.com.
- How to get help — Reply HELP to any message for assistance, or contact us at help@thewaitlist.com.
- Carriers— Supported carriers include major U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages.
- Privacy— Your mobile number and the information you provide are handled in accordance with our Privacy Policy. We do not sell, rent, or share your mobile information with third parties or affiliates for their marketing or promotional purposes.
- Compliance— thewaitlist’s SMS program follows the CTIA Messaging Principles & Best Practices and applicable A2P 10DLC requirements. Messages are delivered via Twilio.
- Changes to these terms— We may update these terms from time to time. Material changes will be posted with a revised “Last updated” date.
The service
thewaitlist provides queue management tools for small businesses. Owners create a queue, customers join it via a URL or QR code, and thewaitlist sends SMS notifications when it's their turn. We provide the platform — you own the relationship with your customers.
Account registration
To use thewaitlist as a business owner, you must provide a valid email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at help@thewaitlist.com if you suspect unauthorized access.
Free and paid plans
- Free tier: Up to 300 outbound text notifications per month. No credit card required.
- Paid tier: $29/month, which includes 1,000 text notifications per month; additional texts are billed at 2¢ each.
We reserve the right to change pricing with 30 days' notice. Changes take effect at your next billing cycle.
Acceptable use
You may use thewaitlist only to manage customer queues for your business. You may not use thewaitlist to:
- Send marketing, promotional, or political messages
- Harass, threaten, or abuse customers
- Operate in regulated industries (healthcare, finance, legal services) without ensuring your own independent compliance with applicable regulations
- Circumvent or obscure the opt-in mechanism on the queue join page
- Resell, sublicense, or white-label access to the service
SMS compliance
Your customers opt in to SMS notifications by submitting their phone number on the queue join page. You are responsible for:
- Ensuring the join page is clearly presented and the opt-in mechanism is not obscured or misleading
- Sending only queue status updates via the notification feature — no other content
- Complying with all applicable federal and state laws governing SMS messaging, including the Telephone Consumer Protection Act (TCPA)
STOP and HELP keyword responses are handled at the carrier level via Twilio. Do not attempt to override or circumvent these.
Account termination
Either party may terminate your account at any time. If you terminate, your data is retained per our Privacy Policy and then deleted. If we terminate your account for violation of these terms, no refund is issued for any unused portion of a paid month.
Disclaimer of warranties
thewaitlist is provided as-iswith no warranties of any kind — express or implied. We do not guarantee uptime or availability of the service, delivery of SMS notifications (carrier conditions apply), accuracy of queue position calculations, or uninterrupted or error-free operation. Use of the service is at your own risk.
Limitation of liability
To the maximum extent permitted by law, Halp Holding LLC's total liability for any claim arising from your use of thewaitlist is limited to the fees you paid in the 30 days preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages — including lost revenue, lost customers, or data loss.
Indemnification
You agree to indemnify and hold harmless Halp Holding LLC and its members, officers, and agents from any claims, losses, or damages — including reasonable legal fees — arising from your use of the service, your violation of these terms, or any SMS compliance issue arising from your customers' interactions with your queue.
Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Pennsylvania.
Changes to these terms
We may update these terms. Material changes will be noted with an updated effective date at the top of this page. Continued use of the service after changes constitutes acceptance of the updated terms.
